The first judgments have already been handed down. <\/p>\n\n<p class=\"has-large-font-size wp-block-paragraph\">Perhaps it also makes sense in your case to take legal action against the payment card.<br\/><\/p>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"has-accent-1-background-color has-background has-large-font-size wp-block-paragraph\" style=\"border-style:none;border-width:0px;margin-top:0;margin-right:0;margin-bottom:0;margin-left:0\"><strong>Why take legal action against the payment card?  <\/strong><\/p>\n\n<p class=\"has-large-font-size wp-block-paragraph\">As the payment card restricts freedom and self-determination, its strict implementation violates the <strong>fundamental right to live in dignity<\/strong>.<\/p>\n\n<p class=\"has-large-font-size wp-block-paragraph\">This fundamental right applies to all people in Germany. It does not matter where they come from, what nationality they have or what residence status they have. The basic right is enshrined in the Basic Law:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"has-large-font-size\">Human dignity is inviolable (Article 1, paragraph 1).<\/li>\n\n\n\n<li class=\"has-large-font-size\">Germany is a welfare state and must provide for its people (Article 20, paragraph 1).<\/li>\n<\/ul>\n\n<p class=\"has-large-font-size wp-block-paragraph\">The payment card also discriminates against people and violates the <strong>right to equality<\/strong> (Article 3, Paragraph 1 of the Basic Law).<\/p>\n\n<p class=\"has-large-font-size wp-block-paragraph\"><\/p>\n\n<p class=\"has-large-font-size wp-block-paragraph\" style=\"border-style:none;border-width:0px;padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--30)\"><strong>Here is an overview of previous procedures:<\/strong> <br\/><a href=\"https:\/\/freiheitsrechte.org\/themen\/gleiche-rechte-und-soziale-teilhabe\/bezahlkarte\"><br\/>https:\/\/freiheitsrechte.org\/themen\/gleiche-rechte-und-soziale-teilhabe\/bezahlkarte<\/a><\/p>\n\n<p class=\"has-large-font-size wp-block-paragraph\"><\/p>\n\n<h3 class=\"wp-block-heading has-accent-1-background-color has-background\"><strong>When can you sue?<\/strong><\/h3>\n\n<p class=\"has-large-font-size wp-block-paragraph\">For example, you can take legal action against the payment card if:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"has-large-font-size\">the \u20ac50 or \u20ac25 cash you receive is not enough because you have special needs and the social welfare office will not give you any additional cash;<\/li>\n\n\n\n<li class=\"has-large-font-size\">you had to give private data to the social welfare office for transfers &#8211; this may violate data protection laws;<\/li>\n\n\n\n<li class=\"has-large-font-size\">you had to pass on information about your lawyers for referrals &#8211; this can violate client confidentiality between you and your lawyers.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<h3 class=\"wp-block-heading has-accent-1-background-color has-background\"><strong>How can you complain?<\/strong><\/h3>\n\n<p class=\"has-large-font-size wp-block-paragraph\">If you also want to take action against the payment card, seek help from an <a href=\"https:\/\/www.fluechtlingsrat-brandenburg.de\/adressen\/\">advice center<\/a> in your area.
